2. Our Services
Our services may include IT hardware and device procurement; corporate IT infrastructure; new and refurbished laptops and hardware; Apple and Mac sales and support; diagnostics and repair, including board- and component-level repair; parts and hardware supply; B2B and channel services; corporate and bulk requirements; pickup and delivery; and buyback, refurbishment, reuse and lifecycle services. The actual scope is the scope confirmed for your transaction.
3. Website Information
Product descriptions, specifications, availability, pricing and timelines on this website are informational unless confirmed through an applicable quotation, order, invoice or agreement. We may correct obvious errors and will communicate material corrections affecting an agreed transaction, subject to applicable law.
4. Enquiries & Orders
A website form, WhatsApp message, service request, procurement enquiry or buyback request does not automatically constitute an accepted order or confirmed booking. Acceptance, scope, price and any necessary approvals must be confirmed through the applicable commercial communication.
5. Quotations & Pricing
Quotations are subject to their stated validity, applicable taxes, availability and the conditions stated in them. Please check specifications, quantities, inclusions and exclusions before acceptance. Material additional chargeable repair work should be communicated for approval before proceeding where required.
6. Product Availability & Procurement
Availability may depend on manufacturers, distributors and suppliers. We will communicate material changes affecting fulfilment and seek approval for material substitutions. No substitution should be assumed solely from a website image or description.
7. Repair & Diagnostic Services
Reported symptoms are not necessarily the final diagnosis. Inspection, testing or disassembly may reveal additional or different faults. Repair feasibility and the appropriate work depend on the device’s condition and findings. Material additional chargeable work should be communicated before proceeding where applicable. A request for diagnosis is not a guarantee that every device or fault can be repaired.
8. Customer Data & Backup
Maintain an appropriate backup before submitting a device whenever reasonably possible and remove sensitive information where practicable. Repairs involving storage, logic boards, operating systems, power faults or liquid damage can involve risk to data. Please tell us about important data or access restrictions before work begins. These responsibilities do not remove NIVIUS’s duties of reasonable care or your mandatory legal rights.
9. Device Access
Device credentials or access should be requested and used only where reasonably necessary for an authorised diagnostic or service activity. Agree any required access arrangements directly with NIVIUS; do not place passwords in general enquiry fields. Access does not authorise unrelated inspection of personal or business information.
10. Parts & Repairs
Parts supplied should correspond with the applicable quotation or service communication. Where NIVIUS states “Apple Original Parts Only”, the relevant service or quotation should identify the applicable arrangement. References to original parts do not imply Apple authorisation, certification, sponsorship or affiliation.
11. Pickup & Delivery
Customers must provide accurate contact, address and device information and follow any agreed packaging and handover instructions. Timing may depend on logistics, location, traffic, weather and circumstances outside reasonable control. Any charges, responsibilities and collection or delivery arrangements should be confirmed for the transaction.
12. B2B & Corporate Transactions
Specific quotations, purchase orders, agreements, statements of work or service-level agreements may contain additional commercial terms. Where expressly agreed terms conflict with these general Terms, the specifically agreed terms take precedence for that transaction to the extent of the conflict, subject to applicable law.
13. Buyback & Device Valuation
Preliminary or online estimates are indicative unless expressly stated otherwise. Final value may depend on inspection and verification of the model, configuration, serial number, functionality, cosmetic condition, battery, previous repairs and components. Any final offer and transfer arrangements must be agreed before completion.
Customers represent that they have lawful authority to sell or transfer devices submitted for buyback and must disclose relevant ownership restrictions. Back up required data and agree any data-removal arrangements before transfer. An enquiry alone does not transfer ownership or guarantee payment.
14. Customer Responsibilities
Provide accurate information, disclose known device damage and relevant restrictions, maintain lawful authority over devices and supplied information, and respond to reasonable requests needed to fulfil the agreed work. Do not submit unlawfully obtained devices or ask NIVIUS to circumvent ownership or access protections.
15. Payments & Taxes
Amounts, payment milestones, accepted arrangements and applicable taxes are those stated in the relevant quotation, order, invoice or agreement. Provide correct billing and tax details. No credit facility, payment partner or payment schedule is implied by the website.
16. Cancellations, Returns & Refunds
Eligibility and the process for cancellations, returns and refunds depend on the transaction and the applicable quotation, invoice or order conditions, subject to Indian law. Contact NIVIUS promptly with the relevant details. These Terms do not impose a universal cancellation charge or refund period and do not exclude mandatory consumer rights or remedies.
17. Warranty
Any applicable warranty period, scope and conditions are those communicated for the relevant product, service, quotation or invoice. Ask for the relevant written terms before proceeding. There is no universal warranty period under these general Terms. Statutory rights remain unaffected.
18. Intellectual Property
Website material is protected by applicable intellectual-property law. Rights belong to NIVIUS or the relevant owners or licensors, as applicable. You may use the website for lawful information and enquiry purposes; no transfer of intellectual-property rights is implied. Reuse beyond what law permits requires the appropriate rights-holder’s permission.
19. Third-Party Trademarks
Apple, Mac, MacBook, iPhone, iPad and other third-party product or company names are trademarks of their respective owners. NIVIUS is an independent technology service/provider. Unless expressly stated based on valid authorisation, references to third-party brands do not imply affiliation, sponsorship or endorsement.
20. Third-Party Services & Links
Third-party links and services are provided for relevant communication or information. Their availability and practices are controlled by their providers and may be subject to separate terms. A link does not itself constitute an endorsement. This does not limit obligations NIVIUS has for services it agrees to supply.
21. Acceptable Website Use
Use the website lawfully. Do not introduce malicious code, disrupt services, attempt unauthorised access, impersonate others, submit fraudulent requests or misuse another person’s data. We may take proportionate steps to protect the website and respond to unlawful use.
22. Limitation of Liability
Each party remains responsible for its obligations under applicable law and the agreed transaction. Responsibility for loss will depend on the circumstances, the applicable agreement and the law, including relevant questions of causation, foreseeability and reasonable mitigation.
Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded or restricted, or removes mandatory consumer rights, remedies or access to competent forums. Any transaction-specific limitation applies only to the extent lawful and agreed. These Terms do not create a blanket exclusion for NIVIUS’s acts or omissions.
23. Privacy & Personal Data
Our Privacy Policy explains how information may be collected, used, shared, protected and retained and how to make privacy requests. Form notices identify the relevant purpose. Agreement to these Terms is not consent to unrelated marketing.
24. Electronic Communications
We may communicate about your request or transaction by email, telephone, WhatsApp or another agreed channel. Keep your contact details accurate and retain relevant quotations and confirmations. A communication is binding only to the extent permitted by law and the agreed transaction; promotional communications remain subject to applicable consent requirements.
25. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Subject to applicable consumer law and mandatory jurisdiction requirements, competent courts in Bengaluru, Karnataka will have jurisdiction. Nothing here prevents you from approaching a consumer commission or another forum available under mandatory law.
26. Changes to Terms
We may revise these general Terms and will publish the updated version and date here. Changes apply prospectively, subject to applicable law; they do not automatically alter an already agreed transaction. Where required, we will communicate material changes or seek agreement.
